By downloading, installing, or using PulseAware ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the App.
PulseAware is an iOS and watchOS application that provides real-time voice analysis and biometric monitoring for communication awareness and self-reflection. The App is intended for personal wellness and professional development purposes only.
PulseAware is not a medical device and does not provide medical advice, diagnosis, or treatment. Heart rate, HRV, breathing, stress scores, and all other metrics are provided for informational and self-improvement purposes only.
Do not use PulseAware as a substitute for professional medical care. If you have health concerns, consult a qualified healthcare provider. PulseAware measurements are not clinically validated and may differ from medical-grade devices.
PulseAware may request access to Apple HealthKit data to personalize your baselines. HealthKit data is used solely within the App for performance analysis. PulseAware will not use HealthKit data for advertising, share it with data brokers, or use it for any purpose other than providing App functionality.
PulseAware offers a free tier with core voice metrics and a Pro tier available as a one-time in-app purchase at $4.99. There are no subscriptions or recurring charges.
Pro unlocks the Apple Watch companion with optional haptic nudges, enhanced on-device recognition, advanced voice and body metrics, deep dives, trends, coaching insights, emotional state inference, and a shareable session summary card. The purchase is processed by Apple through the App Store and charged to your Apple ID. Refunds are handled according to Apple's refund policies.
PulseAware and all associated content, features, logos, and functionality are owned by GMX3C and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of any part of the App without written permission.
You agree to:
PulseAware is provided "as is" and "as available" without warranties of any kind, express or implied. GMX3C shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the App, including but not limited to data loss, service interruption, or inaccurate metrics.
Our total aggregate liability for any claims related to the App shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to us in the 12 months preceding the claim.
You may stop using PulseAware at any time by uninstalling the App. We reserve the right to modify, suspend, or discontinue the App or any features with reasonable notice when practicable.
We may update these terms to reflect changes to the App, legal requirements, or our business. Material changes will be noted in the App or on this page. Continued use of the App after changes constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Dallas County, Texas.
